Allan Kanner, a lawyer for the CLF, argued that the risk has been made clear already. During the historic spring floods in 2010 that inundated large parts of Rhode Island, storm water washed contaminants from the Shell terminal into the river, he said.
The Cape is facing a massive pollution problem because of nitrogen pollution from from septic and wastewater treatment systems. In an effort to curb this toxic pollution, CLF has announced our intention to sue the Wychmere Beach Club and Wequassett Resort and Golf Club for violating the Clean Water Act.
“Nitrogen pollution has disastrous effects on the plant and animal life that live in these beautiful waterways,” said Chris Kilian, Vice President of Strategic Litigation at CLF. “This type of pollution is also harmful to the people who flock to Pleasant Bay and Wychmere Harbor for water sports and other recreational activities. It’s time we hold large polluters responsible for their destructive impacts on our environment.”
“These developers have failed to comply with water pollution control programs as they have rolled out the largest development plan ever conceived in Massachusetts,” said Christopher Kilian, Vice President of Strategic Litigation at CLF. “The discharge of harmful pollutants from this site is degrading the Nashua River and putting the health and safety of nearby residents at risk. The owners of the site have ignored the law, and it’s time they are held accountable.”

We made some progress, but we’re still too far behind when it comes to the long-term funding we need to make true progress on cleaning up Lake Champlain and other ailing waters across the state.
EPA Administrator Scott Pruitt has his sights set on unraveling the Clean Water Act, one of our best tools for protecting our lakes, rivers, and oceans. CLF is working to make sure that the law, which is critical to our work, continues to protect our waters.
Every year, alewives and blueback herring return to their native waters to spawn. But thousands of dams have cut these fish off from thousands of acres of freshwater bodies, thwarting reproductive cycles that had been ongoing for eons. The impact of these dams, on top of threats from pollution and overfishing, have led to a drastic decline in river herring populations – threatening their survival.
“It’s essentially an admission on Shell’s part that the risks we’ve identified in our case are real and imminent,” said Bradley Campbell, president of the CLF, which filed the lawsuit against the oil giant last August.
